PASS OWCP Rep: Here for You

PASS is committed to helping injured union members with their on the job injuries or illnesses. For that reason, as part of the collective bargaining agreements (CBAs) for both Aviation Safety (AVS) and Air Traffic Organization (ATO) employees, the agency is required to annually brief employees on existing requirements and proper procedures for reporting workplace injuries, which is outlined in the annual briefing form found here. PASS provides union members with a specialized Office of Worker’s Compensation Programs (OWCP) representative with whom members should consult when dealing with the intricacy of an OWCP claim.

Under both CBAs, the agency agrees to comply with the provisions of the Federal Employees Compensation Act (FECA) and other relevant regulations set forth by the  OWCP when an employee suffers an occupational disease or traumatic injury in the performance of their assigned duties.

When the agency determines that an employee must be removed from their assigned job, re-assigned, or is returned to work, the OWCP rep is notified and given an opportunity to participate during any meeting where the agency discusses this subject with the affected employee. Of course, this is only if the employee decides to request representation and the rep is able to attend. However, these meetings are scheduled in advance in order to secure the participation of the OWCP rep to assist the employee. A procedural process then follows between the agency, OWCP Program Office and the respective employee where it is determined whether all of the proper documentation has been submitted to ensure that claims for personal injury are processed in accordance with applicable regulations when establishing if the OWCP claim will be accepted.

When facing any work related injury, be sure to review your CBA (Article 83 in the AVS CBA and Article 59 in the ATO CBA) as a point of reference. For additional information regarding an injury or illness, please contact the PASS OWCP National Rep Veronica Benedetto at or 510-712-5183.
